Terms and Conditions

1. Consigner Services:

1.1 Fyx Pal (referred to as “we”, “our”, or “us”) provides consigner services whereby we arrange for subcontractors to perform specified jobs at the customer’s residence.

1.2 Fyx Pal acts solely as a facilitator and coordinator of services and does not employ subcontractors directly. We are not liable for any actions, damages, or disputes arising from the performance of subcontractors.

2. Limitation of Liability:

2.1 Fyx Pal is not responsible for any damages, losses, or injuries caused by subcontractors or their workmanship while performing services arranged through us.

2.2 The customer acknowledges and agrees that any disputes or claims regarding subcontractor performance must be addressed directly with the subcontractor.

3. Subscription Agreement:

3.1 By engaging our services, the customer agrees to a minimum one-year subscription term.

3.2 The subscription term automatically renews on an annual basis unless cancelled by the customer in accordance with the cancellation policy outlined herein.

3.3 The customer acknowledges and agrees that the subscription cannot be terminated before the end of the initial one-year term.

4. Payment and Renewal:

4.1 Fyx Pal has the right to charge the customer’s credit card on file for subscription renewal fees and any additional charges related to services rendered.

4.2 The customer agrees to keep their payment information current and to promptly notify Fyx Pal of any changes to their billing information.

5. Indemnification:

5.1 The customer agrees to indemnify and hold harmless Fyx Pal, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including legal fees) arising out of or related to the customer’s use of our services.

6. Modification of Terms:

6.1 Fyx Pal reserves the right to modify these terms and conditions at any time. Updated terms will be effective immediately upon posting on our website or notifying the customer by email.

7. Governing Law:

7.1 These terms and conditions shall be governed by and construed in accordance with the laws of New York , without regard to its conflict of laws principles.
